Mayor Fenty Signs Landmark Environmental Legislation, Continuing Green DC Agenda


Mayor Adrian M. Fenty has signed a bill, introduced by Ward Six Councilmember Tommy Wells and passed unanimously by the DC Council, to create the Anacostia River Cleanup and Protection Fund. The District Department of the Environment will administer the fund, using the proceeds to educate the public about the impact of trash, to provide reusable bags to District residents, and to remove trash from the river.

“Under this new law, the simple steps we take every day will result in a healthier Anacostia River,” said Mayor Fenty. “Disposable bags are a menace to our waterways, and dramatically cutting down on their use will have a measurable impact almost immediately.”

District businesses will charge customers five cents for every disposable paper or plastic carryout bag beginning January 1, 2010, with the proceeds going to the Anacostia River Cleanup and Protection Fund. The legislation also requires that these bags be recyclable and carry a message encouraging recycling. The bag fee is the first of its kind in the nation, and will not apply to bags used for newspapers, produce, hardware, frozen foods, plants, bakery items or prescription drugs.

“The Anacostia is a river in crisis, and our team sees evidence of that crisis every day with what we pull out of the water.” said DDOE Director George S. Hawkins. “But this bill has given us an extraordinary opportunity. We will now begin a District-wide conversation about trash and its effects, while at the same time removing a major source of that trash.”

By October, DDOE will begin a public education campaign about the new law and establish a public-private partnership to distribute reusable bags to District residents.

The Anacostia River Clean Up and Protection Act of 2009, Bill 18-150, passed the Council unanimously on June 16.

WCP: Catania Abruptly Cancels Hearing on Barry Earmarks

This afternoon, LL and other reporters hoping to follow his Friday scoop showed up to a Wilson Building hearing room to hear testimony on grants earmarked last year by Ward 8 Councilmember Marion Barry.

We were all disappointed.

At-Large Councilmember David A. Catania, which called the hearing to examine the role of “fiscal agents” in administering Department of Health grants, read an opening statement then announced he was recessing the hearing.

In his remarks, Catania explained that he had intended a “hearing of limited scope” about the fiscal agent relationships and “irregularities in the administration” of a particular grant, to Clean and Sober Inc., run by Sharon Wise. Wise, he explained, had contacted him about a contractual dispute, and Catania says he moved to resolve it, but was stymied when Brenda Richardson, Barry’s constituent services maven and a key player in the dispute, declined to cooperate further, via a statement from her lawyer, A. Scott Bolden that cited an ongoing Inspector General investigation.

WCP: Barry Staffer Brenda Richardson Hires Attorney A. Scott Bolden

EXCERPT:

Brenda Richardson, a key staffer in Councilmember Marion Barry’s constituent services office, has hired prominent D.C. attorney A. Scott Bolden. Richardson, who is listed on Barry’s Web site as his Deputy Chief of Staff for Community Engagement, was identified in a recent Washington City Paper story as a key player in Barry’s efforts to control various nonprofit groups that received funding through D.C. Council earmarks.

When contacted on Friday evening, Richardson referred questions to Barry spokesperson Natalie Williams. This morning, Richardson wrote Washington City Paper:

WCP: Barry Involved in Suspect NonProfit Dealings - sent $450,000 to nonexistent organizations

Like all of his colleagues on the D.C. Council, Ward 8 Councilmember Marion Barry has made ample use of the city's legislative earmarks—grants that politicians can steer toward their favorite nonprofit groups.

Yet few have shown Barry's mastery in funneling those earmark monies to organizations that share his agenda. City records show that Barry has directed nearly $1 million in city funds to six groups under the apparent control of his own staff. What's more striking about the arrangements is how they came about:

Barry secured council funding for the groups in June 2008. That was five months before the groups even existed—that is, before they were properly registered with the D.C. Department of Consumer and Regulatory Affairs (DCRA).

The corporation documents appear to be marred by highly irregular representations. Two supposed incorporators of multiple organizations say their signatures were forged onto the papers, and one alleged director is a person who doesn't exist.

The documents were drawn up by paid Barry staffers and notarized by a close political ally of Barry. The incorporation papers for each group were virtually identical, with only the group names and the names of the incorporators and corporate directors changing. A Barry associate closely oversees the operations of all the groups.

The groups have just the sort of names you'd expect from do-gooder associations: the Ward 8 Education Council [
PDF], the Ward 8 Workforce Development Council [PDF], the Ward 8 Health Council [PDF], the Ward 8 Youth Leadership Council [PDF], Clean and Sober [PDF], and Clean and Green [PDF]. They were registered with the city on the same day, Oct. 29, 2008.

Each of them received $75,000—$450,000 total—in District funds.

After revelations that Barry directed $15,000 in council money to former girlfriend Donna Watts-Brighthaupt, the creation and management of the nonprofits raises additional questions about Barry's use of public funds. Under this nonprofit arrangement, he has been able to use the council's earmark allotment to effectively expand his council offices, furthering the reach of his legendary patronage.

Ward 8 (bloggers) Say "No More Barry!"


Despite all the news clips and man on the street interviews by local tv stations of Ward 8 residents fiercely defending (again) Marion Barry's latest round of setbacks there are indeed many, many Ward 8 residents who are indeed sick and tired of the Marion Barry show and seemingly never ending and ever escalating scandals and they are staunchly voicing their opinions - on the internet.


River East blogs are especially important because not only do they offer a perspective often not scene in mainstream media but in many ways they are the ONLY consistent media outlet for River East and act as a forum for River East dialogue to be shared. In addition to the Barry comments expressed here on Congress Heights on the Rise at least two other Ward 8 blogs, Southeast Socialite and The Barry Farms (Re)Mixed have been vocal in the disapproval of Marion Barry as councilmember of Ward 8. They find his actions deplorable and are adamant in their believe that something...anything...must be done to finally put in end to it.

And they are not alone.

"Marion Barry must go" is the constant refraim and it is being repeated on news feedback comments, Facebook pages, text messages, IMs, skype accounts and chat rooms by River East residents. The electronic buzz by frustrated and enraged Ward 8 residents are deafening - if you know where to look.

Question is...who's listening?

The Advoc8te Guest Blogs on Greater Greater Washington

Not to toot my own horn "beep beep" but the folks over at Greater Greater Washington were super nice (and flattering) and asked me to submit some articles to share with their readers what is going on in River East. I was very, very humbled. Many of their readers are from River West (lol) so it's great to share with them in some small part the RE experience and what we are doing over here to improve our community.

WCP: Days Before Arrest, Watts-Brighthaupt Turned Down Barry Contract Offer


I don't think it would have been possible for my opinion of Marion "dangle the carrot" Barry to get any lower until I just read this most recent article by the Washington City Paper. If this isn't sexual harassment I don't know what is. It is deplorable, disgusting and just plain wrong.

I have to admit that as the stories/scandals were evolving I was not very sympathetic to the plight of Ms. Watts-Brighthaupt. I felt that it was no secret that Marion Barry was and is a creep and as such I know I stay away from him as if he had the plague. I would assume that anyone else with any sense would do the same. I underestimated the charm of knowing a famous (or more accurately infamous) man. However I totally appreciated the ability of Mr. Barry to use monetary inducements or the promise of monetary inducements to get his way. We see it every day in the Ward especially during election season when people are clamoring to be a paid campaign worker. Never underestimate the plight of the truly desperate.


I must say that after reading this article and seeing the WashPo video of Ms.Donna Watts-Brighthaupt I must say that I find her to be rather credible and not at all "unstable". Without knowing the entire story just what I have read in the City Paper and in other news publications I applaud her efforts to be taken seriously and to do honest and good work in the community. It is hard enough as a woman in the workplace... especailly a black woman in the workplace. It is horrible that she was pressured in this manner. Kudos to her for standing up and turning down the contract! Kudos to her for having the state of mind to keep evidence of what was happening. I don't find that to be manipulative or explotive at all. Unfortunately it is one of those things that you have to do if you have any hopes of being believed - especially when it involves a powerful man...especially when it involves your boss. I think any woman can appreciate how hard this is.


There is a double standard plain and simple and there is a nasty practice to automatically believe the abuser (in the case Marion Barry) and vilify the victim. It's not only unfair but counter productive. We implore our young women to speak up if someone is abusing them (sexually, verbally, physically) and then we are so quick to not believe them (R Kelly anyone?). It not only gives power to the person holding all the cards but it discourages victims (men or women) to speak up.

Marion Barry was W-R-O-N-G end of story. It was inappropriate and he would not have done it to a man. I am not going to at this time (based off of what I have read/seen to date) going to find any reason to blame/accuse or insult this lady for trying to W-O-R-K so that she can provide for her family. Should she perhaps have left Marion Barry alone permanently or reported this to the authorities early on? Perhaps, but considering the history of Marion Barry being allowed to walk away scott free on so many crimes I don't blame her one bit for not doing it. This is the problem with absolute power - it curropts absolutetly

Was everything done perfectly here? No. But as a woman you learn quick that the same rules that apply to men don't always apply to you and that sometimes just to get in the game you have to take some knocks and dirty play and that is truly horrid.

Every adult in this sad story is culpable in some way but this is yet another (in a very long list) of reasons that Marion Barry needs to be removed from office and quickly. Shame on the City Council if they do not take IMMEDIATE steps to have him removed and he should be prosecuted!!!

Kudos to the City Paper!!!

On the previous Monday, June 29, Barry made a last-ditch offer to maintain his relationship with the woman he had been dating for a year. A key part of his offer was cash: In an e-mail typed and sent that afternoon by aide Brenda Richardson and signed by Barry, he offers Watts-Brighthaupt a part-time job working with Richardson---a job that could pay her as much as $55,000 over the next year.

"I told you today that I thought I could work out a way for you to work with Brenda Richardson whom you like and trust, to work 20 to 25 hours a week for the next three months for $5,000 a month. And I also promise you that I will work out a way for the next 12 months for at least $40,000. Thus we will have $55,000 in the pot."

On Ms. Watts - Brightehapts response:

That night, Watts-Brighthaupt drafted a three-page reply to Barry.

In it, she complains that a proposal she had drafted the previous November pursuant to the $5,000-per-month contract was not taken seriously by Barry or his staff. Her desire for professional validation permeates the letter: Barry’s chief of staff, Bernadette Tolson, Watts-Brighthaupt wrote, had "little respect for me professionally." She expresses great respect for Richardson, Barry's top outreach person, and indeed asks to work with her on the condition that she be allowed to "attend most meetings in a working capacity" and that she be "allowed to share observations and ideas with [Barry] concerning relevant policy and public relations privately in the way in which I (we) are accustomed – debate style."

For this, she asked "for only enough compensation to keep the necessary lines of communications wide open, i.e., cell and home telephone bills."

Watts-Brighthaupt bristled at the suggestion in the Barry offer that they were paying her as a personal favor. And she rejected the proposal. "I feel as if I'm selling my soul to you for the tax payer’s dollar,” she wrote.

WASHPO: For Barry, a Familiar Script Takes an Unfamiliar Twist


This article which appears in today's Washington Post is unique for two reasons. The first is that it's the first time City Coucilmembers are at least making noises (albiet off the record) that perhaps Mr. Barry's actions in regards to the contracts awarded to his then girlfriend were possibly improper. The Second, your own The Advoc8te was quoted in the article. Even bigger news- The Advoc8te really is not the late great Eartha Kitt. LOL.

It started with an arrest, as it often does. There was a woman involved, as there usually is. And there were the denials, controversial behavior by the police and extraordinary news conferences that feed a local media obsessed with Marion Barry. Within his inner circle, there were the normal efforts to get Barry to back off. As always, he largely ignored the advice.
The initial reaction from outside Barry's world was just as routine: near silence from his fellow D.C. Council members and unwavering support from his constituents, even though to much of

Washington Barry long ago ceased being a power player.

The drama could have ended yesterday evening when authorities announced that they were dropping the stalking charges that again put Barry's personal life on display. For his backers, this was evidence that the former mayor is as much a victim of overzealous police as he is a man who seems to court trouble. But there's the likelihood of an investigation into his then-girlfriend getting a $60,000 council contract from Barry (D-Ward 8), which means the sideshow spectacle could continue.

At a 9 p.m. news conference, Natalie Williams, Barry's spokeswoman, said Barry was "thankful" that the U.S. attorney's office decided not to prosecute.

"The short answer is, this is over," she said later.

However, there were calls for an investigation into Barry's use of public funds. His friends and supporters said they are worried about the job given to Donna Watts-Brighthaupt, the woman who police say accused Barry of following her, leading to his arrest Saturday. Records indicate that the payments and cancellations of the contract coincide with their makeups and breakups. So far, Watts-Brighthaupt has been paid $15,000, and at Barry's request, the secretary of the council has approved an additional payment of $5,000.

Shame Spiral, Thy Name is Marion Barry

Editors Note: This post was originally posted on 7/7/09 in response to Marion Barry's stalking scandal. Since that time further scandals involving possible conflict of interests and voicemail messages have been brought to light. Rather than create another long post about why I am still humiliated about my respresentation on the city council I would rather just repost. In fact I may just carry this around in my purse and just whip it out whenever I am blamed as a Ward 8 resident for Marion Barry being re-elected.


The Advoc8te would much rather discuss POSITIVE Ward 8 and River East news but unfortunately the antics of Councilman Marion Barry have once again thrown a monkey wrench in our hopes for the future. Yet again, we are forced to endure the all too familiar but no less humiliating escapade that continues to be the saga (or cautionary tale) of Marion Barry's life. Meet our latest reality show, The Marion Barry Show.
Whether you deem this latest controversy as a private or public matter the fact remains that Barry's personal life IS having a negative effect on his ability to perform his duties and therefore having a negative impact on the lives of his constituents. How can you focus on his achievements with all the distractions caused by his antics? How can you take someone seriously who is the ultimate political punchline? It is obvious from his refusal to resign (or move) that Marion Barry is without shame but must he continue to send me (and an entire community of folks) down a shame spiral with his never ending 3 ring circus of a life?

If there was ever a time for a "come to Jesus" talk it's now. I can't help but imagine that if this was not a Ward but a private company and if Barry was simply an employee and not a politician wouldn't the time have come by now for his boss to call him into the office, close the door and admonish him one last time about the frequency and length of his personal phone calls while on company time and finally give him his walking papers? The point I am trying to make is that there comes a point when your poor personal judgement has an impact on your professional goals or those of your employer. They are called "morals" clauses or the less formal but equally important "I am not going to embarrass myself or my company/organization/brand because of your shenanigans" clauses and if they aren't in city contracts (such as council member contracts) then they should be.

Barry's frequent run-ins with the law (there comes a point when you have to put your big boy underpants on and call it what it is) are detrimental to the progress that so many are working for in our community. It effects not only how Ward 8 and Ward 8 residents are viewed but how they view themselves. What an erroneous message to send that THIS is our best hope for representation. What does it say of our collective sense of self value? Of our VALUES?

We are forced yet again to endure another barrage of seemingly never ending slurs and prime time jokes leveled at the insanity and foolishness that must be the Ward 8 voter, because according to the entire nation only fools (or sadists) would continue to vote this man into office. I have my own personal theory as to how Mr. Barry has retained his Ward 8 seat despite all his legal and financial scrapes or his ever declining health. Almost anyone who is a newcomer to the Ward has experienced it in varying degrees - the distrust of outsiders and change. The Ward 8 culture is one where change is not only looked upon suspiciously but in many circles it is avoided like the plague. Change in any form is frowned on, is cause for an outcry and has become the litmus test for weeding out "the outsiders". Anyone who has casually used the term "River East" only to be verbally assaulted has experienced that fear of change firsthand.

Whether based in truth or in conjecture "change" in Ward 8 (or any any poor consistently disenfranchised community) has become synonymous with the scariest of all words - gentrification. It is this fear that with the change of old but familiar faces, new development and a new way of doing things that there will not be a place of the table for the original (often disenfranchised) resident. That is what is so scary for way too many and which is most baffling to most who aren't familiar with the Ward 8 culture of fear and distrust of outsiders.

Psychologically it is understandable. When a group of people have been historically left behind and overlooked in in terms of jobs, education and basic human services there is some basis for this fear of being "swept under the rug and then out of the door". No one doubts that Marion Barry, the politician is second to none. You will be hard pressed to find one so politically savvy and more in tune to the feelings and fears of his base. Therefore despite his failings (and there is no one in Ward 8 who can not concede there are at least some) his popularity at the polls is far less a reflection on his popularity but on the fear that drives them to the polls election after election. Barry's wins at the polls are far less an endorsement of the man but far more a desperate hope that they (the disenfranchised) will at least in some perfunctory manner have a place at the table - never mind that the seat is more figure head than function.

Barry in all of his different incarnations...hero or villain represents the last hope for so many. If he stays (despite all his shortcomings)...they stay. There is such a hope by his base that if they keep hanging in there with him one day he will finally come through for them - they use the early days of the summer jobs program as a reminder for themselves that this was a man of vision. Although the argument can be made that Barry has far less in common (economically speaking) with his disenfranchised base than ever before because despite the judgements, garnishments and liens on his salary Marion Barry is a man who earns $115,000 a year - a far cry from the average Ward 8 resident. He goes on exotic vacations when the average Ward 8 resident has rarely been far out of town. He regularly travels in circles with the movers and shakers of America when his residents are historically an afterthought at best. The undeniable and very sad truth is that the longer he stays in office the more it almost guarantees that his die hard supporters will ultimately be left (either through his retirement or death) totally unprepared for the change in culture and community that is coming. It would be far better for them to be stakeholders in the Ward 8 of today and tomorrow than victims of the broken promises of yesterday or years past.

There are no "timeouts" in the game of life just because you have a bad day or a bad player. The plans are still being made, deals for redevelopment are still being struck and more and more new residents move into the Ward everyday. You can't stop it. It's been happening and it's happening right now. For many the game will be in it's final stages before they even realize the game has even started. That is what makes Marion Barry so dangerous. That he is able to consistently and very easily able to manipulate misplaced fears of his base to advance his own agenda. Who but the die hard Barry supporter suffers the most from his inability to do a great job? Not only are they forced to defend his actions and numerous liberties with the law but they are generally the most in need of a capable (and focused) advocate in the form of an effective council member. For Barry's lifelong base it is far easier to believe that Barry is a victim of a huge conspiracy to bring him down as opposed the less complicated and far more likely scenario of a person past their prime trying to hold on to their job at all costs. A (lost) hope born out of out of fear, propaganda and apprehension is what Barry has and continues to benefit from.


In short, despite all my hopes to the contrary Marion Barry (in all of his cluster *&%! glory) is indeed Ward 8 news and as such he (and the never ending parade of news stories that his arrest has generated) must indeed be included on CHOTR. To be fair some of the coverage has been entertaining. Only a player (and former paid consultant) in the Barry drama would release a 3 PAGE STATEMENT to the media. The Advoc8te has seen less incoherent rambling on a discarded bar napkin.


Let's pray this latest Barry "mistake in judgement" is short and sweet and that hopefully (oh so hopefully) there can be a somewhat lengthy hiatus until the next Barry controversy.


So for all my fellow Ward 8 residents who are once again embarrassed, frustrated and dismayed by the latest Barry drama let us all hunker down, wait out the media firestorm and remember throughout to hope for the best (jail) but be prepared for the worst (reelection). Let us all keep in mind that our representation on the City Council is NOT representative of the many intelligent, truthful, law-abiding, tax paying and simply BORING members of the Ward 8 community.

What we wouldn't give in Ward 8 to have a nice BORING (and law abiding) Councilmember? Ahhh...I imagine it must be like Zanadu! The Advoc8te is hopeful that "we too shall overcome someday".

Oh well...here we go again.

P.S.The Advoc8te is considering posting one of those clocks on the blog that says "X Days since last Marion Barry scandal". I have a sneaking suspicion it would never get into the double digits.

Buy Ward 7 & 8 Challenge - Put your money where your home is!

With all the Barry drama The Advoc8te has been remiss in posting this. It is an excellent idea that was created by a great River East (representing Ward 7) blogger Ms. V over at http://fairfaxvillage.blogspot.com/Life In The Village. Ms. V. tracks her daily River East spending on her blog - excellent idea. I may have to track my River East spending the same way . If you haven't yet paid a visit to Life In The Village please do - it's a great blog!

Good Morning Neighbors,

Today starts the impromptu Buy Ward 7 and 8 Challenge. For the entire month of July, try to ONLY spend your hard earned dollars in Ward 7 and 8. As one resident suggested, if you can't find the brands that you need, don't be afraid to contact the store manager/owner and request what you need. Please keep track of how much you spent for the month.
Someone emailed me suggesting that the participants meet in early August to talk about the challenge, so stay tuned for more information on that. (To get you started check out the business listings at www.dhmainstreets.org and www.ward7bpa.org.)
